Konukçu asked Interior Minister Ali Yerlikaya: “By what right do the governor of Istanbul and the police prevent the constitutional right to assembly and march?”
DEM Party Istanbul MP Kezban Konukçu brought the detention of women and LGBTI+s by police violence on November 25, International Day for the Elimination of Violence against Women, to the agenda of the Parliament.
Konukçu submitted a parliamentary question to Minister of Interior Ali Yerlikaya and said:
“Women and LGBTI+’s in Turkey greeted November 25, the International Day for the Elimination of Violence against Women and Solidarity with increasing violence and femicides as a result of the current government's hate language against women and LGBTI+’s, its sexist policies and perspective that tries to devalue women, along with the negativities forced by the economic crisis every day.”
Referring to the ban imposed by the Istanbul Governor's Office, Konukçu reminded that 169 people were detained and press members were attacked and added:
"It is the responsibility of the state to prevent violence and to secure the right to life of women and LGBTI+’s. The demand of every woman in this country is to achieve gender equality, to live safely and to lead a decent life."
“Who ordered the intervention?”
Konukçu asked the following questions to Minister of Interior Yerlikaya:
- By what right do the governor of Istanbul and the police interfere with the constitutional right to assemble and march against increasing violence and femicide?
- Why is there no effective investigation and punishment policy against the crimes and abuse of power by the police?
- Who gave the order to intervene against women protesting against male domination, male violence against women, harassment, rape and femicides, peacefully exercising their democratic right to demonstrate, and against members of the press who were doing their duty?
- Are there any investigations against the Governor of Istanbul and the Istanbul Police Department regarding the beatings and detention of women and their being kept in handcuffs in detention vehicles?
- The Governorate's ban violates fundamental rights guaranteed by the Constitution, IHAS and international conventions, including the rights to freedom of assembly, freedom of expression and non-discrimination. The ECtHR ruled in DİSK and KESK v. Turkey, 27.11.2012 T. 38676/08, that the right to freedom of assembly also includes the right to 'freedom to choose the place of assembly and demonstration'. The Constitutional Court, with its decision of 12.10.2023 T. 2016/14517 S., ruled that the categorical prohibition of the freedom to choose the venue is a violation of constitutional rights. Do you have any investigation initiated against the banning decision of the Istanbul Governorate, which violates the constitutional and international rights of women by violating the Constitution and European Court of Human Rights (ECHR) decisions?
