The first re-trial of the case where Buse Kılıçkaya is seeking for justice is going to take place on 13 October 2015, at 10:00 am, in Ankara 15. Court of First Instance. Humans right activists call everyone for following her case.
On 19 June 2010, 3 trans human rights defenders who are founders of Pembe Hayat, were asked for detention without any reasons presented to them by police officers, while driving in the city center; they were forced to be brought to the police station by violence. While the request of plaintiff by trans human rights defenders who were subject to violence and insult, about perpetrator police officers to the relevant state prosecutor was dropped, the request of plaintiff by police officers who perpetrated violence was accepted, and a public court case by state prosecutor against 3 trans human rights defenders was opened on the charges of “resistance to prevent duty”, “insult to officer on duty” and “damage to public property”. As a result of the trial, Pembe Hayat Association’s chair-person, Buse Kılıçkaya, was sentenced to 5 months in prison on the charges of “resistance to officer on duty”, other 2 activists were relatively sentenced to 6 months and 1 year and 6 months in prison.
While the verdicts on decisions on other activists were postponed for later, the prison sentence on Buse Kılıçkaya was forced to be executed immediately.
This verdict was objected by Buse Kılıçkaya to be re-evaluated at the higher court. The Supreme Court’s 18. Penal Chamber broke the decision of local court about Bus eKılıçkaya with the charges of “resistance to prevent duty”; the verdict being explained as lack of sufficient proof on explaining how the attributed violence and threat were formed, an deven though if the crime be accepted as present, there is a need of an evaluation about unjust provocation by reading through the forensic report supporting the fact that Buse Kılıçkaya’s arm was hurt after being hit with a walkie talkie.
